While the global threat of Ebola Virus Disease in 2014 was concentrated in several West African countries, its effects have been felt in many developed countries including the United States. Initial, select patients with EVD, largely among American health care workers volunteering in affected regions, were subsequently transported back to the states for isolation and treatment in high-level medical facilities. This included Emory University Hospital, which sits adjacent to the federal Centers for Disease Control and Prevention in Atlanta, Georgia.The (...) first domestic case of EVD occurred in late September in Dallas, Texas. Additional exposures of two HCWs generated an array of legal issues for state and local public health authorities, hospitals, and providers. Consideration of these issues led to extensive discussion among lawyers, public health practitioners, and other attendees at a late-breaking session on EVD and Legal Preparedness at the 2014 National Public Health Law conference. In this commentary, session presenters from CDC and Emory University share their expert perspectives on legal and policy issues underlying state and local powers to quarantine and isolate persons exposed to or infected with Ebola, as well as facets of hospital preparedness underlying the successful treatment of patients with EVD. The earth's temperature, with rapid global warming over the past 30 years, is now passing through a period of relatively stable climate that has existed for more than 10,000 years. Further warming of more than 1°C will make the earth warmer than it has been in a million years. "Business-as-usual" scenarios, with fossil fuel carbon dioxide emissions continuing to increase approximately 2 percent annually for several more decades, yield additional warming of 2° to 3°C this century and imply changes that (...) constitute practically a different planet. Multiple lines of evidence indicate that the earth's climate is nearing, but has not passed, a tipping point, beyond which it will be impossible to avoid climate change with far-ranging undesirable consequences. The changes include not only loss of the Arctic as we know it, with all that implies for wildlife and indigenous peoples, but losses on a much vaster scale because of worldwide rising seas. Sea level will increase slowly at first, as losses at the fringes of Greenland and Antarctica due to accelerating ice streams are partly balanced by increased snowfall and ice sheet thickening in the ice sheet interiors. But as Greenland and West Antarctic ice is softened and lubricated by melt-water and as buttressing ice shelves disappear because of a warming ocean, the balance will tip to rapid ice loss, bringing multiple positive feedbacks into play and causing cataclysmic ice sheet disintegration. The earth's history suggests that with warming of 2° to 3°C, the new equilibrium sea level will include not only most of the ice from Greenland and West Antarctica, but a portion of East Antarctica, raising sea level of the order of 25 meters. In discussing the Bible as literature, I am simply going to assume that the Bible, particularly in the King James version, is great literature. I am also going to take for granted the fact that its stories and themes have continually sparked the literary imagination of the West. From the story of Adam and Eve in the Garden to that of the Resurrection we have a set of symbols, motifs, and themes whose reworking has been the subject of (...) the bulk of our literature. I am not going to discuss this influence, nor even discuss the Bible as a piece of literature, i.e., as a particular literary work. What I am going to do is to focus on what is involved in our taking it as literature. More particularly, I am going to look at how we approach questions of truth in a literary work. I am going to ask how far we can push this approach when we come to read the Bible. What are the limits in reading the Bible as literature? When does the notion of “truth” as it arises in a literary text begin to fail us. That it will fail us at a certain point is implicit in the Bible’s claim to be “sacred scripture” or “revelation.” If we take this claim seriously, we naturally have a special approach to the “truth” its text contains. But what precisely is this approach? This is what I want to explore. In other words, my goal in exploring the limits of the literary approach to the Bible is to gain some insights into the sacred character of its text and how we should approach it. §1. Truth and the literary text. The most common, if often overlooked feature of a successful literary work is that of presenting us with a world In a certain sense, it succeeds by having inherent standards for what can belong to it, of what fits in with its sense and what does not. We live in an age of massive efforts to transplant Western institutions. Some of those efforts have involved the so-called "Washington Consensus"; some have involved International Human Rights; but all of them have brought the West to the rest of the world, and all of them reflect a kind of missionary drive. What are the historical sources of this legal missionizing? This Article argues that those sources long predate the twentieth century, and indeed long predate the colonial adventures that (...) began in the sixteenth century. Western law was already culturally predisposed to spread well before Iberian ships reached the Americas. In particular, Western law began, in antiquity, as city-state law, and only gradually penetrated the countryside. This colonization of the countryside by the cities took place partly under the influence of Christianity. It also reflected a centrally important event in the development of Western law: the great northward shift of the center of gravity of Western culture from the Mediterranean to trans-alpine Europe, which we can roughly date to 700-1000 C.E. The long, slow internal colonization of the countryside in the West set much of the pattern for the external colonization of the non-Western world that eventually commenced in the sixteenth century. Feminist, critical race, and postcolonial theories have established that social identities such as race and gender are mutually constitutive—i.e., that they “intersect.” I argue that “cultural appropriation” is never merely the appropriation of culture, but also of gender, sexuality, class, etc. For example, “white hipness” is the appropriation of stereotypical black masculinity by white males. Looking at recent videos from black male hip-hop artists, I develop an account of “postmillennial black hipness.” The inverse of white hipness, this practice involves the (...) appropriation, by black men, of stereotypical white gay masculinity and/or non-American, non-white femininity. I also argue that Shephard Fairey’s recent images of (mainly militant) non-Western women of color can be read as a new form of white hipness that revises the traditional logic in two ways: (1) by appropriating non-white femininity rather than masculinity, and (2) by adopting the practice of postmillennial black hipness itself. Cloth. $19.95.Originally delivered in the spring of 1965 and subsequently broadcast several times over the BBC, Berlin's lectures on romanticism have long been esteemed by his (...) admirers. Berlin nevertheless resisted their publication, hoping one day to write a book on romanticism. His literary executor Henry Hardy reports, however, "not so much as a sentence of the intended work was ever written" (x). Thus Hardy's edition of these lectures constitutes Berlin's most extended reflection on a theme that loomed large in his understanding of the modern world: the romantic critique of the Enlightenment.Surprisingly few romantics actually appear in these pages. Those who do arrive late, linger briefly, and are usually German. Fichte enters on page 88, followed by Schelling (97) and the Schlegel brothers (104), with brief appearances by E. T. A. Hoffman and Johann Ludwig Tieck (114-6). Only in his closing ruminations on the impact of romanticism does Berlin cast a glance at Byron, Chateaubriand, and Sir Walter Scott. Most of the book explores what Berlin takes to be romanticism's "roots," which he locates in a few eighteenth-century German writers who, when romanticism finally burst upon the scene, were either disgusted by it (Jacobi, Schiller, and Goethe) or dead (Hamann). A few years later Berlin made these proto-romantics the charter members of the movement he dubbed "the Counter-Enlightenment"—a concept that would have a considerable career of its own. Berlin's concern is thus less with romanticism per se than "with the revolution of which romanticism, at any rate in some of its guises, is the strongest expression and symptom" (xiii).As Berlin saw it, this revolution involved a rejection of the idea that 1) "all [End Page 451] genuine questions can be answered," 2) "all these answers are knowable," and 3) "all these answers must be compatible with one another" (21-2). Upon these three principles, he insists, "the whole Western tradition rested" (21), and their rejection constitutes "the greatest single shift in the consciousness of the West" (1). Berlin holds that the Enlightenment left these principles unshaken. It was the romantics who questioned the "ruinous" belief that "there is one single solution to all human ills" (which carries the insidious corollary that "you must impose this solution no matter what cost") and thus laid the foundations for "liberalism, toleration, decency and the appreciation of the imperfections of life" (146-7), causes which are usually associated (wrongly, according to Berlin) with the Enlightenment.These arguments will not be unfamiliar to those who know Berlin's works. Reading him is a bit like listening to Vivaldi: taken individually, his essays are clever, vigorously argued, and elegantly crafted; but reading them in sequence soon leads to a nagging sense of having heard it all before. Berlin's work was animated by an awareness of the diversity of plausible answers that could be given to the question of how life should be lived and by an impassioned defense of this plurality of possibilities against the illusion of an ultimate solution. One can admire the defense of liberalism that Berlin drew from these convictions and yet have reservations about the historical accuracy of his account of the relationship between romanticism and the Enlightenment. It is hard to see Hamann as a supporter of pluralism and harder still to see the philosophes—who rejected the dogmatic esprit de systèm in favor of an experimentalist esprit systématique—as oblivious to the multiplicity of ways in which good lives could be lived. Lessing's views on religious questions were a good deal more skeptical and open-ended than Jacobi's. Fichte and Schelling sought to bring a greater systematic coherence to Kant's philosophy, not to dismantle it. Once one moves from general claims about "romanticism" and "the Enlightenment" to assess specific thinkers, the picture becomes a good deal messier than Berlin lets on. Early romantics... (shrink)

Few interpreters of Aristotle have denied that both empirical, inductive methods and some kind of systematic deduction played a role in the philosophy of the biologist who expounded the West's first formal logic. But it has usually been the fashion to focus on one side of this polarity. In recent decades the focus has been on the empirical Aristotle. But some of the latest studies emphasize that Aristotle varied his methods according to context. G. E. L. Fenner confines his study to Western aesthetics and does not address the aesthetic traditions of Asian philosophy. This is not, by any means, a limitation, as this restriction of scope makes Fenner's work more concise and readily (...) accessible to those unfamiliar with aesthetics.Fenner divides his book into four parts: "Experiences," "Objects and Events," "Meaning," and "Judgment." Part 1 discusses the meaning and scope of the term "aesthetic" and analyzes the significance of "aesthetic experiences" and "aesthetic properties." Here, Fenner also explains the notion of aesthetic attitude as it is understood from the traditional perspective of disinterest (which includes thinkers such as Kant, Schopenhauer, and Stolnitz) and from modern points of view (such as Bullough's psychical distance and Aldrich's impressionistic vision).Part 2 contains three chapters, which discuss the nature of aesthetic objects, the definition of "art," and the concept of creation and re-creation. In the 1940s and 1950s _The Review of Politics_, under the dynamic leadership of Waldemar Gurian, emerged as one of the leading journals of political and social theory in the United States. Efforts to conserve endangered species of animal are, in some important respects, at odds with Buddhist ethics. On the one hand, being abstract entities, species cannot suffer, and so cannot be proper objects of compassion or similar moral virtues. On the other, Buddhist commitments to equanimity tend to militate against the idea that the individual members of endangered species have greater value than those of less-threatened ones. This paper suggests that the contribution of Buddhism to the issue of species conservation (...) should not, however, be discounted. It argues, on the contrary, that Buddhist traditions, in reminding us of the moral significance of the suffering of individual animals, add an important dimension to debates concerning the ethical justification of efforts to conserve endangered species.
